contracters are just as bad....when I built my home years back, the stupid contracters stuffed garbage left from their lunches in my insulation and down the heater vents, I would go to inspect my home everynight after they were working on it and find garbage all the time, when the homeowners next to me went to change their stair case they found a bag of trash stuffed under the stairs, left from the builders. So I say it goes either way.. Just too bad people can not be grown up and take responsibility for their actions.

When I was going thru school _about 12 decades ago_ I worked construction with guys that did things like this. You wouldn't believe some of the stuff these morons did! They would put any kind of trash or whatever in between the studs, cover it with insulation and wall board. Most homeowners never knew. I was ashamed to work with those guys.

It drives me crazy.....when I hear about people trashing their house after they are forclosed on. It's dishonest! I'm sorry they lost their house but it is very immature to distroy the house they once owned. Grow up and take your lumps like honest people.

I don't understand this either. Why would you want the people who eventually buy your house to think you are a pig. We had to forclose once when my husband was laid off. I was sad to leave our little home. I cleaned it nice before we left. I didn't want to be thought of as the pigs that lost thier home. It's already bad enough to have to look like losers for fore closing.

It's not the new owners fault that you couldn't pay on your home. It's yours. Whether you lost your job and couldnt' help it, it's still your fault and not the new owners. Logic, good for you for leaving your house the way it was. :)

You can't charge someone with destruction of property for trashing their house... Until the foreclosure actually happens, the house belongs to them, and there's nothing the bank can really do.
When the article says "occasionally the bank goes after them", it can only mean that they pursue a deficiency judgement after selling the house for less than is owed, because they have little to no recourse regarding the fixtures in the house. Even if there are stipulations in the deed requiring that you not vandalize the house during foreclosure, it's impossible to prove that the homeowner hadn't just started to remodel the house, then ended up in foreclosure for whatever reason.

Disagree? Why? I don't like it, but it's the truth.. you can't prosecute someone for vandalizing something they own, and the bank has no way to prove when the damage happened. They have NO right to enter the property prior to COMPLETING the foreclosure, so as long as the damage happens before the foreclosure is complete, the bank has no recourse other than to pursue a deficiency.

Simply put, while you own the home and attached fixtures you have signed them over as collateral for the loan. If it is not illegal to deliberately damage or remove portions of that collateral then it should be.
I quote without permission:
"You['re] correct that you own the home and everything in it including fixtures such as toilets etc. However, when you signed your closing documents you agreed to use the home and everything attached to it such as toilets etc. as backing for the loan you got from the bank. You still own it but if you don't make your payment, the home and everything attached to it goes to the bank. There is no excuse for this to happen and those who do it belong in jail. It is illegal to trash a home you have a mortgage on even though you own it."

While I agree with you.... the foreclosure rate is going to keep on climbing. Many of these foreclosures are coming from people who do and can afford to pay their bills. The problem lies with deflating property prices. It is easier to walk away from a home if you are upside down 100k or so. So unless the banks that loaned on these "overpriced" properties start doing voluntary write downs on the loans, expect the foreclosures to keep on climbing.

Deflating property prices don't mean squat unless....... you bought it as an investment or to flip it and/or you are using your house as an ATM machine. Is it the bank's fault that you wanted to purchase an overpriced property?
If you can make the payments and you bought the house with the intent of making it your home, what is the big deal?
Like a previous poster mentioned, they are simply white (black, brown, red, green, et al) trash.

People who put big holes in wall, leave animal waste, break things, etc. are the one who are upset. One can probably buy these fixtures and appliance for cheap now that there are so many foreclosed homes.

Who are you talking about? I am a real estate agent, is that who you are referring to? My only comment is actually a question: Who was the real estate agent that you had such a bad experience with? I didn't get my license till lust under a year ago but have been involved in real estate as an investor for 3 years. I used a Realtor before I got my license and never had a problem. I am pretty sure that agents never forced anybody to sell or buy a home, with the exception of the criminals. I just am not understanding the hatred you feel toward people that sell homes for a living. I guess I have one more question, do you own a home?

not in my case, I just did one almost a year ago, and at that time my credit rating dropped to 580, 8 months after the fact, I'm sitting at 700. The only reason my score dropped was due to my missing 2 months mortgage. I was going to foreclose, but changed my mind. Worked out great for all of us!

But as a reminder, I sold my home, the first mortgage got their money and the 2nd mortgage, got the remainder of cash once the first got theirs. So in a sense, I paid my bill. The 2nd Mortgage company agreed to take a cut! Case closed, credit saved!!!

Our home was taken through foreclosure in 2007. The first mortgage company was paid in full, via the lien placed on the property. The second mortgage (down payment) was also cleared via the lien placed on the property. You can't transfer the deed to someone without the liens being cleared. The sale of the home gave us $23,000 in profit. This money was put into an escrow account in the State of Utah District Court. It cost an additional $1,000 to file for the money to be disbursed to us.
I also disagree with the statements of trashy people having home ownership.
With the loss of a job, health issues, cut backs in hours worked, anyone could find themselves in the same situation. Even with a rainy day fund you eventually run out of money. The mortgage company would not let us make partial payments on a regular basis to prevent the foreclosure. The housing market was booming at this time.
Any item permanently affixed to your home should stay. But when you purchase a home there should be a listing of all attached fixtures as a part of the closing. When our home was purchased, it didn't come with a fridge, dishwasher, stove, window covering or any upgraded light fixtures. Save the old fixtures when you replace or upgrade. The only item we were allowed to take was the fridge, because I could produce a receipt to show the purchase date.
Utah real estate prices have been out of line for too long. Lets hope for the best.

This inflated the home price bubble and caused everybody who recently bought a house to overpay. Blame the Democrats (Obama including) for causing it, blame the Republicans for being too afraid to open this can of worms and fix it.

You are wrong! I am sorry wise one, but you are way off here! It's not just the people buying more house than they could afford that are losing their homes. I don't have my dream home, I have the home I could afford 8 years ago when I bought it. I have 1980's butcher block looking counter tops, no island, no stainless steel, no fancy anything. I have been in my home for 8 years and I had never been late on a payment. However my husbands work cut back his hours which is the majority of our income, anyway we were 1 month behind for 3 months, we were still making payments but had gotten behind, the mortgage company was calling daily, ready to take our home, they would do nothing to help. Luckily with a lot of hard work and sacrifice we are cought up again. The banks are ruthless, they recieved millions of dollars and they can not even defer one payment for someone who is trying everything to get caught up. It's not just the people in the fancy homes!

This is an interesting concept... While it is true that renting will never build you a nest egg or any kind of wealth, it is very wrong of politicians to perpetuate the myth that everyone should be able to own a home. Some people do not have the skills necessary to maintain a home. Some do not have the resources. And some are just too unstable to make a payment for 30 years straight. In the past, middle-class, middle-age people bought homes. The young learned how to be frugal with their money in order to save up a down payment for their first home over periods of years. Politicians have made it way too easy for the unqualified to get in over their heads.

If I was a bank, I would chase after these folks till they have NOTHING left. Many of these crooks have been living the high life off of the HELOC $$$$ that was NEVER theirs to begin with, then they get angry when the house gets taken away. Where does this mentality come from???
This is one of the reasons that I still believe that we have a LONG LONG way to the bottom of real estate. IMO, at least another 25% down.

With a short sale, at least the first mortgage gets all their money, the 2nd will be fortunate to get any remaining cash from the home sale! Nobody just walks away in a short sale. Now a foreclosure is much different!
The lenders who lend out a 2nd mortgage know the risks and are just plain stupid to give out unsecured loans! They are the real crooks!!!

"wise" one How much money do you hope to see the banks and lenders pay lawyers to go after people with little or no money? Do you really think THAT will help? Ever hear of "trowing good money after bad"? The only ones who will win in these situations are the lawyers; that is why many of these lenders can't go after default borrowers.
Also, not all of the foreclosures are on "crooks and deadbeats"; many are people who were trying to get into RE investing and got burned.

The Banks should do this but... they also should keep a record of what the house looked like/contained when the loan was signed. Sort of like a rental...any upgrades I put into the home after the loan was signed, I just might take if "IF" I leave it in the same or better condition compared to when I "bought" it. IE move $500 fridge to garage, put new $2000 fridge in kitchen, move $500 fridge back to kitchen, keep $2000 fridge. But what the lady did in the video was plain wrong.

I have a realtor friend who lists and sells foreclosures and she is constantly finding abandoned
animals in the houses. Sometimes it is a really long

These people probably couldn't afford a house to begin with, but since homes were as cheap as renting and your credit score could be 500, then they bought one. So when things went south, they reverted to their trailer mentality and destroyed what they had because they felt they were owed something. These people probably thought Obama was going to pay their mortgage for them.

What?Everyone is only looking at the people with fancy homes that are losing them, but people with smaller less expensive homes are losing them also. After the housing prices dropped so much and people were losing their jobs or getting hours cut back, no one could re finance for a lower payment or etc because the appraisals were really low, for example I owe about $150,000.00 on my home, in October 2007 my home appraised at $185,000.00, now since people are selling their homes for just what they owe or with short sells, it shows homes in the area being sold for $120,000.00 to $140,000.00 which means that's all you will get in an appraisal because they go off of comparisons. Luckily my house payment is current and I don't have to worry about selling my home or a foreclosure right now, but the economy has hurt a lot of people and foreclosures are not only happening to the people who bought more house than they could afford, it's happening to a lot of people.

It's not always the home owner that trashes the house... I know someone who lost a house a few years ago and she thought she was doing the right thing by moving out immediatly, however the house sat vacant for several months before the forclosure process was complete and someone had gone in and gutted the whole house. She hadn't even finished moving out and they stole the ceiling fans, Water Heater, and several other things. Once word gets out that a house is vacant it can and probably will get ransacked!

I would never buy a home. never want. everyone says why do i rent! i just say look at everyone losing their homes and the credit. I still have a place to go to bed and my credit is great. i dont have to spend money when my heater goes out or my water heater. i can move when my job want to go to another city or state and not have to worry if my house will sale so to these people losing there home sorry but don't every make fun of me for renting.

Why are we blaming the Banks... I think the real problem here is all the middle men involed in the real estate market. I mean, lets use our tech and cut these poeple completly out of the process. Like do we we really need to pay 350 to 400 to an appraiser to do something any 5th grader can do using the internet and public records for free. And we should eliminate the 6 % real estate agents by making the multiple listing WEB SITE public. And modernize the title process. and lastly all these scum bag flyby night mortgage companies who are not even a bank. Just think of the savings for real hard working Americans if we revamped the entire real estate industry. Let’s start using 21st century technology and lets cut out all these middle men and there cuts.

Just FYI... The multiple listing service was created and is now updated daily for and by real estate agents. If it wasn't for Realtors, it wouldn't exist. It is public, go to utahrealestate.com. I agree with your subject though, we shouldnt be blaming the banks.

Back in the day... When I was looking for a houses to buy, we came across a bank owned house. The previous owners had torn out the water heater and just let the water run and run.
When we came to the house. The basement was filled with water and there was mold growing up the walls on the 2nd floor.
It could have been a pretty house, but would have cost me even more just to fix the damage these lameos did to it.
If you get foreclosed on, just leave with dignity. sheeesh.

This sounds so childish... BUT if you're getting foreclosed on then there is a reason.. like you're way past due on your mortagage payments. What choice does the bank have if you're not paying? Go peacfully.. because you are accountable for your bill.

Greedy Banks... They got the bailout and they won't even refinance good loans. I tried to contact my mortgage company to do a simple refinance to the record low interest rate of 4.5%. Instead they wanted a full blown loan and new loan term of 30 years. I only have 15 left. I wanted to get out of debt sooner not later. My home is still worth $250,000 and I only owe 100k what the heck is wrong with them. I hate CITI
